Welcome to MyCARealReport. These Terms of Service (“Terms”) govern your use of the website, account, and services provided by My CA Real Report LLC (“MyCARealReport”, “we”, “us”, or “our”).
1. Acceptance of Terms
By creating an account, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, you may not use the service.
2. Our Services
We are a third-party disclosure provider under California Civil Code §1103.7. We provide enhanced Natural Hazard Disclosure (NHDS) reports that include:
- All statutorily required disclosures (FEMA flood, dam inundation, Alquist-Priolo, seismic, fire hazard zones, etc.)
- Climate-enhanced projections (wildfire probability, extreme heat, flooding) using Cal-Adapt and other public data
- Supplemental environmental screening (LUST, PFAS, Superfund, DTSC, etc.)
Reports are generated for informational purposes only and are intended solely for the specific real estate transaction involving the buyer, seller, and their licensed agents.
3. User Accounts
You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use.
4. Ordering and Payment
You may submit orders without immediate payment. We will review each order and issue a manual invoice. The report is not valid or deliverable until the invoice is paid in full. Payment must be made via the method specified on the invoice.
5. License to Use Reports
Upon full payment, we grant you a limited, non-exclusive, non-transferable license to use the report solely for the specific real estate transaction identified in the order. You may not reproduce, distribute, or resell the report or any portion of it.
6. Disclaimer of Warranties
Our reports are based on publicly available data and government maps at the time of preparation. We do not warrant that the information is complete, accurate, or free from error. The reports do not constitute insurance, a warranty, or professional advice (legal, engineering, environmental, or otherwise). You should consult qualified professionals for any decisions involving the property.
7. Limitation of Liability
To the fullest extent permitted by law, MyCARealReport and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of our services or reports. Our total liability shall not exceed the amount actually paid for the specific report in question.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the reports or breach of these Terms.
9. Governing Law
These Terms and any dispute arising out of them shall be governed by the laws of the State of California, without regard to conflict of law principles. Any legal action must be brought in the courts located in Los Angeles County, California.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date. Your continued use of the service after changes constitutes acceptance of the new Terms.
